Terms of Service.

These terms govern your use of this website and any quote, order, delivery, installation or support you arrange with us. Please read them before placing an order.
1. About these terms
These terms of service ("Terms") govern your access to and use of the Hyperbaric HQ website at hyperbarichq.com (the "Site"), and any quote, order, purchase, delivery, installation or support you arrange with us. Hyperbaric HQ is a registered business name of Resonance Dynamics Pty Ltd (ABN 89 697 256 741) ("Hyperbaric HQ", "we", "us" or "our"). By using the Site or placing an order with us, you agree to these Terms. If you do not agree, please do not use the Site.
2. Definitions
"Equipment" means the hyperbaric chambers, environments, oxygen systems and related accessories we supply. "Order" means a request to purchase Equipment that we have confirmed in writing. "Site" means this website. "You" means the person or organisation using the Site or placing an Order.
3. Using the site
The Site and its content are provided for general information about the Equipment we supply. We take care to keep information accurate and current, but specifications, availability and pricing may change without notice. Information on the Site is an invitation to enquire, not an offer capable of acceptance.
4. Quotes, orders and pricing
- Prices are shown in Australian dollars (AUD) and, where applicable, include GST.
- A quote is an estimate based on the information available at the time and is valid for the period stated on it, or 30 days if no period is stated.
- Where we describe pricing as "delivered and installed", that reflects standard delivery and installation for typical sites within our service area. Sites with access, structural, electrical or location constraints may require additional work quoted separately.
- No Order is binding until we confirm it in writing. We may decline or cancel an Order before delivery — for example, where Equipment is unavailable or a pricing error has occurred — and will refund any amount you have paid for a cancelled Order.
5. Payment
Payment terms are set out in your quote or invoice. Unless agreed otherwise, we require a deposit to confirm an Order, with the balance payable before or on delivery and installation. Title to the Equipment passes to you once we receive payment in full. Risk passes to you on delivery.
6. Delivery and installation
- We deliver and install Equipment within Australia. Timeframes are estimates and depend on stock, freight and site readiness.
- You are responsible for ensuring the installation site is safe and ready, with suitable access, space, power and any consents required.
- If a site is not ready at the agreed time, additional delivery, storage or re-attendance costs may apply.
7. Warranty and after-sales support
The Equipment we supply is covered by a manufacturer's warranty, the terms of which are provided with your Equipment. This is in addition to the rights and remedies you have under the Australian Consumer Law. We provide after-sales support and servicing as described in your Order documentation.
8. Your rights under the Australian Consumer Law
Our goods and services come with guarantees that cannot be excluded under the Australian Consumer Law. For a major failure with goods, you are entitled to a replacement or refund, and to compensation for any other reasonably foreseeable loss or damage. You are also entitled to have goods repaired or replaced if they fail to be of acceptable quality and the failure does not amount to a major failure. For a major failure with a service, you are entitled to cancel your service contract and to a refund for the unused portion, or to compensation for its reduced value. Nothing in these Terms limits these rights.
9. Returns and cancellations
Because Equipment is supplied, delivered and installed to order, we do not offer change-of-mind returns once an Order is confirmed. This does not affect your rights under the Australian Consumer Law. If you need to change or cancel a confirmed Order, contact us and we will let you know what is possible and any costs already incurred.
10. Safe use of the equipment
The Equipment must be used only in accordance with the manufacturer's instructions and any guidance we provide. You are responsible for operating and maintaining the Equipment safely, and for ensuring anyone who uses it does the same. Individuals should consult a qualified healthcare professional before use.
11. No medical or therapeutic claims
Hyperbaric HQ supplies barometric chambers and environments. These products are not registered as medical devices on the Australian Register of Therapeutic Goods (ARTG). No therapeutic claims are made or implied. These products are not intended to diagnose, treat, cure or prevent any disease or medical condition. Any information on the Site is general in nature and is not medical advice.
12. Intellectual property
All content on the Site — including text, images, video, logos, product names and trade marks — is owned by or licensed to us and is protected by law. You may view and share it for personal, non-commercial use. You may not copy, reproduce or use it commercially without our written permission.
13. Third-party links and content
The Site may link to third-party sites or embed third-party content, such as video. We are not responsible for the content, products or practices of third parties.
14. Limitation of liability
To the extent permitted by law, and subject to your rights under the Australian Consumer Law, we are not liable for any indirect or consequential loss arising from your use of the Site or the Equipment. Where our liability cannot be excluded but can be limited, our liability is limited, at our option, to resupplying the goods or services or paying the cost of doing so. Nothing in these Terms excludes, restricts or modifies any guarantee, right or remedy you have under the Australian Consumer Law that cannot be excluded.
15. Privacy
We handle personal information in accordance with our Privacy Policy, which forms part of these Terms.
16. Changes to these terms
We may update these Terms from time to time. The current version is always the one published on the Site, with the "last updated" date shown above. Continued use of the Site after an update means you accept the revised Terms.
17. Governing law
These Terms are governed by the laws of New South Wales, Australia. You and we submit to the non-exclusive jurisdiction of the courts of that State.
